Terms of Service

Effective date: 2026-05-07. These Terms govern your use of PermitPulse, a service operated by Ondium, Inc., a Massachusetts S Corporation ("Ondium," "we," "us," "our"). PermitPulse is a "doing business as" name of Ondium, Inc. By subscribing, you agree to these Terms.

The service

Ondium, Inc. dba PermitPulse provides aggregated, classified municipal building-permit information by email and through subscriber-only dashboards. The service is provided on a subscription basis through Stripe, Inc. as our payment processor.

Subscription, billing, and cancellation

Subscriptions renew automatically until canceled. You can cancel from the Stripe customer portal at any time; cancellations take effect at the end of the current billing period. We do not lock you into multi-period contracts. Annual subscribers retain access through the end of the paid year.

Refunds

Email ops@permitdaily.com within seven (7) days of any charge if you believe a refund is warranted. Refund decisions consider data quality, service downtime, and good faith on both sides. Founding Members receive a separate full-refund commitment if the first daily digest is not delivered by 2026-06-15, as stated on the Founding Member offer page; that commitment supersedes this section for the first charge of qualifying Founding Member subscriptions.

Founding Member subscriptions

Subscribers who join under a Founding Member offer ("Founders") receive a 50% discount that applies for the lifetime of the original Founding Member subscription. The discount is tied to the original subscription only; if you cancel and later re-subscribe, the founding discount does not transfer to the new subscription. If we discontinue or materially alter the Founding Member price ID, we will honor your founding discount by migrating you to the closest then-current subscription tier at a proportionally equivalent discount, or, at your option, by refunding any charges paid for periods you do not wish to retain.

Acceptable use

Subscriber data is for the subscriber's internal commercial use. Bulk redistribution, resale, or scraping of our outputs to power a competing data product is not permitted without written agreement.

Data accuracy

We make a reasonable effort to classify and enrich permit records accurately, but the underlying public data may contain errors, omissions, or delays. We provide outputs "as is" and recommend you treat individual records as informational, not as the basis for irrevocable commercial decisions.

Liability

To the maximum extent allowed by applicable law, our aggregate liability for any claim arising from the service is limited to the amount you paid us in the prior twelve months.

THE SERVICE AND ALL DATA, OUTPUTS, DIGESTS, EXPORTS, AND DASHBOARDS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. ONDIUM, INC. DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, OR FREE FROM INACCURACIES IN UNDERLYING PUBLIC RECORDS.

Governing law and venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Subject to the Arbitration section below, any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to personal jurisdiction and venue there.

Arbitration; class-action waiver

YOU AND ONDIUM AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE (each a "Dispute") SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where applicable, its Supplementary Procedures for Consumer-Related Disputes. The arbitration shall be conducted in Boston, Massachusetts, or by video, at the arbitrator's discretion. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

CLASS-ACTION WAIVER. YOU AND ONDIUM AGREE TO BRING DISPUTES AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN CLAIMS OF MORE THAN ONE PERSON AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING. If this class-action waiver is found unenforceable, then the entire Arbitration section shall be null and void as to that claim, and that claim shall proceed in court under the Governing law and venue section above.

30-day opt-out. You may opt out of this Arbitration section by emailing ops@permitdaily.com with subject line "ARBITRATION OPT-OUT" within 30 days of first becoming subject to these Terms. Opt-out does not affect any other section of these Terms.

Changes

We will notify subscribers by email at least fourteen days before any material change to these terms takes effect.
